The European Commission yesterday announced a new probe into the UK’s Capacity Market scheme to investigate whether it complies with EU legislation, after a surprise court ruling in November effectively revoked its EU approval. The ruling found the European Commission should have more closely investigated the UK’s plan to establish the scheme – which pays generators for providing back-up power to the grid during peak time in the winter months – before it launched in 2014. The Capacity Market was immediately suspended by the UK government following the ruling.
